IJU exposes false claim by rival group

Respected Sir,

Sub: Information regarding the Civil Suit bearing CS No.133 of 2011 (Presently 56481\2016) titled as Indian Journalists Union versus K. Sreenivas Reddy, Sh. S.N. Sinha, Sh. D. Amar & Ors before the court of Hon’ble ASCJ/JSCC/GJ/MM, Patiala House Court, New Delhi, and claim filed by this defected faction.

1.       That an advertisement was published for claim of Unions in the Press Council of India on 7th March, 2021.

2.       That as per the advertisement the undersigned was required to submit the pending disputes in the court anywhere in the country.

3.       That the Indian Journalists Union (IJU) is an all India registered organisation and was duly represented in the Press Council of India before its 13th term.

4.       That the Indian Journalists Union (IJU) was registered under the Trade Union Act on June 08, 1990 and its registration No. is 4001.  In the advertisement it is mentioned that the climant  organization shall also subscribe to a declaration establishing that the claim of the said body is valid and free from all encumbrances\disputes\litigation.  The Press Council may at its discretion  reject  any claim if such encumbrances are brought to its notice.

5.       That in response to the said advertisement the undersigned is submitting as required by the advertisement dated 07th March 2021 that the Civil Suit bearing CS No.133 of 2011 (Presently titled as 56841\20) Indian Journalists Union versus K. Sreenivas  Reddy, S.N. Sinha, Sh. D. Amar & Ors is pending before the court of Hon’ble ASCJ/JSCC/GJ/MM, Patiala House Court, New Delhi.

6.       That it is further brought to your kind notice that  faction of Mr K. Sreenivas Reddy (defected faction of IJU)  has filed the claim in the name of Indian Journalists Union (IJU) before the Press Council of India.  It is pertinent to mention herein that Mr. K. Sreenivas Reddy has defected from the mainstream of IJU and the IJU has no connection with the defected faction of Mr. K. Sreenivas Reddy.

7.       That under the influence of owners of News Paper Industries, a faction of Journalists consisting of members of Andhra Pradesh Union of Working Journalists (APWJ), Hyderabad & Tamil Nadu Union of Journalists (TUJ), Chennai (now divided in four groups) along with few dissident individuals from 2-3 State Unions of the Indian Journalists Union (IJU) have indulged in dividing the IJU.  Ultimately, after one and half year of internal anti-union activities the faction of the said group has defected from the main stream of IJU on 05-03-2011 and now they are being represented by Mr. K. Sreenivas Reddy.  They are falsely and malafidly representing themselves as IJU office bearers.  It is made clear that the IJU has no connection with the defected faction whatsoever.

8.       That on the other hand the majority of the State Union, remained united together with the IJU and have also expressed their full faith  in the leadership of Mr. B.R. Prajapati, the President of the IJU and Mr. G. Prabhakaran as the Secretary General of the IJU.

9.       That despite the disassociation and defection from the majority group of the State Unions of the IJU affiliated, the defected group as mentioned above is illegally and malafidly using the name and seal of the IJU.  As such to restrain them from such activities and further to restrain them from using the name and seal of the IJU, the Indian Journalists Union (IJU) has filed a civil suit for declaration and permanent injunction bearing CS No.133 of 2011 (Presently 56841/2016/ titled as Indian Journalists Union versus K. Sreenivas Reddy, Sh. S.N. Sinha, Sh. D. Amar & ors before the court of Hon’ble ASCJ/JSCC/GJ/MM, Patiala House Court, New Delhi.  The said Civil Suit is pending adjudication and is at the stage of Plaintiffs Evidence.

10.   The notice dated 07-04-2021 issued by the Press Council of India is showing  the name of Mr. Bilwinder Singh Jammu, Secretary General of defection faction of Indian Journalists Union (IJU) (who represented\filed claim for nomation before the Press Council of India in the name of Indian Journalists Union.  It is submitted tha he belongs to the faction defected from the Indian Journalists Union (IJU) as mentioned above and is illegally and malafidly using the name and seal of the IJU.

It is further submitted that of Mr. Balwinder Singh Jammu, Secretary General of the defected faction of IJU has misrepresented and has dishonestly and malafidly submitted its representation in terms of advertisement dated 07-03-2021 of Press Council of India.  Mr. Sreenivas Reddy is the President of the defected faction of IJU.

11.   Thus, it is hence clear that till the Civil Suit for declaration and permanent Injunction bearing CS No.133 of 2011 (presently 56841\2016) titled as Indian Journalists Union versus K. Sreenivas Reddy, Sh. S.N. Sinha, Sh. D. Amar & Ors before the court of  Hon’ble ASCJ\JSCC\GJ\MM, Patiala House Court, New Delhi and  the matter is sub-judice before the competent court of law.  Hence, Mr. Balwinder Singh  Jammu, Secretary General of the defected faction of IJU has no oral\legal and legitimate right to file its claim before PCI.  Further, the defected faction of IJU has no moral\legal and legitimate right to claim or represent them as IJU and use the name and seal of the Indian Journalists  Union (IJU).

12.   Thus your good self is humbly informed and requested not to entertain the claim of  Mr. Balwinder Singh Jammu, Secretary General of the defected faction of the IJU, Sri K. Sreenivas Reddy. Sh. S.N. Sinha, Sh. Devullupalli Amar and any other person of the defected faction of Indian Journalists Union (IJU) till the matter is finally adjudicated by the Hon’ble Court.  It is further requested to your good self to reject the claim by any person from the defected faction of the Indian Journalists Union (IJU) in the Press Council of India in the name of Indian Journalists Union (IJU) in the interest of justice.
